The National Communications Authority (NCA) has issued a Notice of Proposed Licence Amendment to Next-Gen InfraCo (NGIC), seeking to remove the 5G exclusivity clause contained in the company’s licence.
In a press release dated March 4, 2026, the Authority explained that the proposed amendment is being pursued under Section 14 of the Electronic Communications Act, 2008 (Act 775). According to the NCA, the decision is aimed at promoting competition and innovation in the delivery of 5G services across the country.
The regulator indicated that the move is in the public interest and is intended to enhance consumer choice, improve service quality, accelerate nationwide digital transformation, and ensure the optimal and efficient use of spectrum as a national resource.
Under the statutory provisions, the proposed amendment will take effect ninety (90) days from the date of the notice, unless otherwise determined after consideration of any representations made by NGIC within the notice period.
The NCA further assured the public that due process is being followed and that the action aligns with its mandate to regulate communications services in a manner that safeguards the national interest.
Meanwhile, the Authority disclosed that NGIC has so far installed forty-nine (49) 5G sites across the country. Out of the total number, forty-three (43) are located in the Greater Accra Region, while Ashanti Region has two sites. The Western, Northern, Bono, Central regions each have one site.
In a related development, the NCA noted that NGIC is currently in default of its licence fee instalment payment under the Schedule of Licence Fee Payments, which forms part of its licence conditions. The Authority stated that the matter is being addressed in accordance with the applicable licence conditions and statutory provisions.
The NCA reaffirmed its commitment to transparent, fair and predictable regulation to ensure sustainable investment, competition and growth in Ghana’s communications sector.
